Update: In 2013, the ACLU of Illinois moved to dismiss the case after the Illinois General Assembly approved – and the governor signed – marriage equality for all in our state.

On behalf of nine Illinois couples seeking recognition for their shared love and commitment, the American Civil Liberties Union and the ACLU of Illinois have filed a lawsuit to challenge the constitutionality of Illinois' law that denies gay and lesbian couples the freedom to marry. Currently, Illinois law excludes gay and lesbian couples from the recognition and protections that come with the universally recognized relationship status of marriage, and limits them instead to a separate civil union status.

A number of the plaintiffs sought a civil union after they were available in 2011, although some chose to wait for marriage. In the complaint, these couples describe how it feels to be relegated to a legal status that sends the message that the state regards their relationships as inferior. Couples also report the multiple ways in which they are reminded that many people do not understand civil unions, nor do they afford civil unions the same respect as marriage.

In a separate case filed on the same day, Lambda Legal is representing 16 same-sex couples seeking the freedom to marry. The coordinated cases signal the organizations' shared commitment to ensure that the government treats all families fairly.

The ACLU and the ACLU of Illinois are assisted in the lawsuit by the Chicago office of Mayer Brown.

“Solo quiero estar casado con la persona que amo” Eso es lo que Tanya Lazaro, una veterana de 13 años (y una detective) de la Policía de Chicago, dijo al Chicago Sun Times como parte de una entrevista para un artículo en el periódico de esta mañana anunciando que la ACLU y la ACLU de Illinois han presentado una demanda buscando la libertad de matrimonio para las parejas del mismo sexo en Illinois. La demanda esta siendo coordinado con Lambda Legal que presenta hoy una demanda similar de parte de otros parejas. La ACLU representa nueve parejas en total. El diverso grupo está compuesto por personas de la edad de 30 a 70 años. Ellos viven en todo Illinois- desde un suburbio del norte de Chicago hasta Marion en el sur de Illinois. Algunos tienen hijos y otros no. Una pareja tiene 22 nietos-con otro en el camino. Sin embargo,  todos comparten la misma esperanza y aspiración a la dignidad y el reconocimiento de sus relaciones amorosas y comprometidas que solo el matrimonio puede ofrecer. Ed habla con elocuencia y pasión de querer que su matrimonio con Gary en Canadá ser reconocido en su estado natal para que pueda disfrutar de sus “años dorados” casado con la persona que ama. Randy Walden y su futuro marido Robert Carey de Springfield saben que solo el matrimonio asegurará que ellos no reviven las horribles circunstancias que Randy se enfrentó cuando su compañero de mucho tiempo, Curt, murió de cáncer. Cuando Curt fue hospitalizado, el personal cuestionado regularmente su relación, ignorando los deseos de Curt de que Randy tomar los decisiones de atención medica para él. Randy no fue permitido pasar la noche con Curt en el hospital- este privilegio fue reservado solamente para esposos. Una mañana, Randy se precipitó a la cama de Curt y lo encontró cerca de la muerte. The Associated Press published an article on Friday's hearing on the motion to dismiss in the two marriage cases, Darby v. Orr and Lazaro v. Orr, which are being handled by Lambda Legal and the ACLU of Illinois respectively and represent a total of 25 couples seeking the freedom to marry in Illinois. The case will now move on to hear arguments from the couple's side about how the current law discriminates based on sexual orientation.

Chicago Tribune: Federal judge orders Cook County to issue wedding licenses to same-sex couples facing serious illnesses.

The Chicago Tribune reports Cook County Clerk David Orr may immediately begin to issue marriage licenses to same-sex partners combating life-threatening diseases. Couples who present the clerk’s office with physician-certified verification of their illness will not have to wait for the new marriage equality law to go into effect on June 1 of next year. The judge’s order came in response to a class action suit brought by a coalition of attorneys that included the ACLU. The Tribune writes:

Chicago Sun Times: Sneed: Almost 1000 gay couples have filed for Cook county marriage licenses

According to columnist Michael Sneed, Cook County Clerk David Orr’s office predicts that it will soon issue the 1000th marriage license to same-sex couples. In February, Federal Judge Sharon Johnson Coleman ruled for immediate marriage equality in Lee v. Orr, a suit brought by the ACLU of Illinois and Lambda Legal, and ordered the Cook County Clerk’s office to promptly begin issuing marriage license to same sex applicants. Since then the office reports processing over 950 license applications and that a third of the applicant couples traveled from other Illinois counties to Orr’s office to obtain a marriage license. The Clerk’s office anticipates reaching the 1000 milestone as soon as Friday. Courtney Greve a spokeswoman for Orr’s office stated:
