Rule of Law Prevails in Critical Supreme Court Cases on Post-9/11 Detentions

The Supreme Court of the United States delivered a blow to the Bush Administration's policies with regard to detention of individuals without judicial (or any other kind) of review. In two cases -- one involving the detention of a U.S. citizen as an enemy combatant and another involving the detention of hundreds of persons at the naval base at Guantanamo Bar -- the Court found that the President did not have a "blank check" to act during a time of war or threat to national security. In response to the decisions, ACLU of Illinois Executive Director Colleen Connell called the decisions "an emphatic repudiation of the Bush Administration's argument that its actions in the war on terror are beyond the rule of law and unreviewable by American courts." In the decision, Justice Kennedy noted that "Content-based prohibitions, enforced by sevarl criminal penalties, have teh constant potential to be a repressive force in the lives and thoughts of a free people.
